[MCOH-EH] Employee Health Record and HIPPAA

AT our hospital we do consider our Employee Health records as protected information .  This in part because we have health assessment information , medical information, clearances, etc... etc.. We make the employee sign a release before we print any collated items from our history or copy anything from the chart that we are able to release.

Most of the needle sticks at our facility occurs in the operating room.  I am looking for teaching material to do education. Problem is most of the needle sticks is due to  carelessness when more than one set of hands is in the surgical space.  The only solution that I can find is to annouce when reaching into the surgical field such as (the tech should announce that he/she is reaching for suction) therefore making the surgeon aware that another pair of hands is entering the surgical space.  Does anyone have any ideas of how to reduce needle sticks in the operating room?

Colleagues,

In my role as president of an employee health software company, I am rooutinely asked to sign Business Associate Agreements (HIPAA confidentiality agreements) with the hospitals using our software -- since in the course of converting their legacy databases and providing ongoing support, we routinely view medical information pertaining to employees, volunteers, contractors, students and licensed independent professionals.

Today I was intrigued that an individual with the title General Counsel for Health Sciences informed me that their medical center does not consider the personal medical information contained in their employee health database to be protected by HIPAA. I'd be interested in knowing how prevalent this position is. Has anyone else been given that information by their hospital's legal department? If you're not comfortable revealing the name of the institution, please feel free to reply to me individually rather than to the entire list.
