Good evening,

I wanted to provide you with a status on Code.org's progress toward compliance with our state data privacy law. School starts soon (if not already) for most Connecticut districts, many of which plan to use the Code.org platform during the 2018 - 19 school year.

We have had multiple, productive discussions with Code.org's leadership and legal team, followed by several weeks of quiet while they develop an updated set of terms. Very late last week, I received a draft agreement from Code.org that appears to comply with our state law. I am now waiting for the Code.org team for details on when the new terms will go into effect and the process by which districts can review and execute the agreement, a requirement of the law. As soon as I have more details about Code.org, I will share them with you all.

As a reminder and disclaimer, the Commission does not provide official legal review of software terms, such as those of Code.org. Creating and executing compliant contracts are the joint responsibility of districts and their providers. We have tried to facilitate that process by engaging major ed tech operators, hosting the Education Software Hub<https://ctedtech.app.learntrials.com/users/sign_in>, and offering resources for districts and companies at StudentPrivacy.CT.gov<http://studentprivacy.ct.gov/>.
