[MCOH-EH] Marijuana

The current plan is that we will not employ persons on medical marijuana. Our legal department has determined that it is not a "reasonable" accommodation for a healthcare worker in need of this drug to allow them to work while using this drug. We know it is not safe to perform their duties while under the influence of this drug, and length of time it is in the system is unpredictable, and the worker may come to work impaired. We treat benzos and opioids the same way - they cannot be under the influence of these drugs at work. The only difference is that it is easier for an MRO to monitor use of benzos and opioids outside of work via levels in the urine, while measuring marijuana use is all over the board. Candidates will be notified up front that we do not employ persons using marijuana for any reason.

I will be following this thread as well as my organization is currently evaluating.
At this time, post-offer drug screens still include THC. Any positive results is read as positive. There is not an option for the MRO to determine negative based on medical recommendation. We are in California where recreational marijuana is legal but we still follow Federal statues in regards to drug screens for post-offer physicals.

List,
With the changes in some state laws regarding recreational marijuana, I would be interested in hearing how other healthcare organizations are handling pre-placement drug screening for THC. Are THC positive drug screens excluded from employment? Has anyone stopped testing for THC in pre-placement screening? Do you handle medical marijuana differently than recreational?
Thank you,
