I agree with Warner's comments. I believe it is prudent to have consistent policy and best to follow Federal law and/or rule such as MRO because marijuana remains schedule I. http://www.dea.gov/druginfo/ds.shtml
Even where there are state initiatives making marijuana "legal", federal law trumps state law. Absent zero tolerance policy, one creative lawyer in California has successfully made employer pay for alcohol rehab (court ruling) in a work comp case as he argues "but for the work injury, the patient would not have started alcohol abuse"; and is pushing to make employer pay for marijuana rehab if injured worker should start smoking pot and get addicted. Can they? Yes, they could.

We fail medical marijuana as not a pass per our policy. We follow federal rules as a federal contractor and the medical marijuana dispensary MD recommendation is not a true DEA license based prescription that can be filled in a licensed pharmacy again per policy. Marinol Rx filled before positive would be a pass. Don't see many of these however. Warner
